- GENERALITIES -

These General Terms and Conditions of Sale (GTC) govern all online sales contracts for products offered on the caftanfamily.fr website, belonging to CAFTAN FAMILY, hereinafter referred to as "the Seller". The GTC apply exclusively to purchases made by non-professional individuals, hereinafter referred to as "the Customer(s)" or "the Consumer(s)", having the status of consumers.

The T&Cs prevail over any other conditions or contradictory documents that may appear on other channels, such as social networks, physical stores or any other form of direct sales.

These General Terms and Conditions are accessible at any time on the caftanfamily.fr website, particularly before placing your order. It is advisable to consult them regularly, as CAFTAN FAMILY reserves the right to modify them at any time. However, the applicable General Terms and Conditions are those in force on the date the order is validated.

Validation of your order on caftanfamily.fr constitutes full and complete acceptance of these General Terms and Conditions, without restriction or reservation. You acknowledge having read the General Terms and Conditions before finalizing your purchase and declare that you accept them.

In the event of the nullity of a contractual clause, the other provisions of the General Terms and Conditions remain fully applicable.

- PREAMBLE -
The Seller is a publisher of ready-to-wear products for children and adults, exclusively for consumers, marketed through its websites http://www.caftanfamily.fr. The list and description of the goods and services offered by the company can be consulted on the aforementioned sites.

- PRODUCTS -

Before placing an order, CAFTAN FAMILY recommends that you consult the detailed description of each product available on the caftanfamily.fr website. This description includes in particular the essential characteristics of the product, in accordance with Article L. 111-1 of the Consumer Code, its composition, its capacity, as well as its price.

CAFTAN FAMILY offers two categories of products:

• In-stock products: These items are immediately available for purchase and are deliverable within standard lead times.
• Custom-made products: These items require a production time of between 4 and 6 weeks.

Contractual information is presented in French and confirmed at the latest at the time of validation of your order.

As a customer, you are solely responsible for the choice of product and the order placed. The photographs and illustrations used to present the products have no contractual value and cannot engage the responsibility of CAFTAN FAMILY in the event of slight variations or different interpretations of the products received.

The items available on caftanfamily.fr at the time of your visit are those offered for sale on the site. Product availability is updated regularly.

- AVAILABILITY -

Products are available while stocks last. In the event of a product being out of stock, CAFTAN FAMILY will inform you promptly. You will then have the option of choosing an equivalent product at the same price, or of benefiting from a credit valid for 2 months on the entire caftanfamily.fr website.
If no solution suits you, you can request a refund for the unavailable product. CAFTAN FAMILY undertakes to refund the sums paid within a maximum of 14 days following your request. The refund will be made according to the payment method used for the initial purchase.
CAFTAN FAMILY cannot be held responsible for cancellation compensation, unless the non-performance of the contract is directly attributable to it.

- ORDER -

The order process is as follows:

1. The consumer selects the product of their choice (as well as the size, color and quantity) and clicks on the “Add to Cart” button. If the consumer clicks on the “Buy Now” button, they go directly to step 3, without going through step 2.
2. The consumer goes to his virtual shopping cart, where the order summary appears, including the total amount excluding shipping costs. He is required to check this information before continuing.
3. By clicking on the "Proceed to payment" button, the consumer arrives on a page where he must enter his contact details, choose his delivery method and enter his shipping address. At this stage, the consumer can enter a valid promo code if he has one.
4. By clicking on the “Continue to shipping” button, the consumer chooses the payment method that suits him.
5. By clicking on the "Continue to payment" button, the consumer provides the information necessary for payment. Confirmation of the order by the consumer entails acceptance of the General Terms and Conditions and forms the contract.

Products in stock:
The sale becomes final after sending the consumer confirmation of acceptance of the order by CAFTAN FAMILY by email. This confirmation is sent without delay, after receipt of the full price.

Custom products:

Custom-made products are subject to a manufacturing period of 4 to 6 weeks, as specified when ordering. Confirmation of the order by the consumer and acceptance by CAFTAN FAMILY form a distance contract. At this stage, the order cannot be modified, except with the express and exceptional agreement of CAFTAN FAMILY, and cannot be cancelled.

Cancellation and refusal of order:

CAFTAN FAMILY reserves the right to cancel or refuse any order for legitimate reasons, including in the event of a dispute with the consumer regarding a previous order. The order may also be refused if the quantities ordered are abnormally high compared to those usually ordered by consumers.

- PRICE -
The prices displayed on the caftanfamily.fr website are indicated in euros (€), all taxes included (TTC), excluding shipping costs.
The sale price of the product is that in effect at the time of the order.

The prices take into account any reductions granted by CAFTAN FAMILY for orders placed during the validity period of a promotion, subject to compliance with the conditions specified on the website caftanfamily.fr.

The prices displayed on the caftanfamily.fr website are valid only for mainland France.
In accordance with article L 112-1 of the Consumer Code, the price of the product is clearly indicated when registering your order, before confirming it.

Delivery and transportation costs as well as additional taxes will be calculated and indicated before the final confirmation of your order, at the payment stage.
The total amount of the order, including these charges, will be specified on the order confirmation page.

CAFTAN FAMILY reserves the right to modify prices at any time, however, the price applicable to your order is the one displayed on the caftanfamily.fr website at the time of the order.

- DELIVERY -

In accordance with Article L 216-1 of the Consumer Code, delivery means the transfer to the consumer of physical possession or control of the goods.

CAFTAN FAMILY offers its products for sale internationally. Orders will be delivered to the address provided when placing the order. It is important to carefully check the address before confirming your order, as any input error will be your responsibility, including reshipping costs which will be your responsibility and not covered by CAFTAN FAMILY.

Delivery time :
The delivery time varies depending on the delivery method chosen by the consumer:

• Colissimo (La Poste): 2 to 3 working days* from dispatch of the order
• Mondial Relay: 3 to 5 working days* from dispatch of the order
• Click and collect: Delivery within 24 to 48 hours from the preparation of the order
• Delivengo, Happy Post: Variable time depending on the carrier

*The above mentioned deadlines are given as an indication and may vary.

International Shipping: Delivery time varies depending on the destination country.

For any order over €150 excluding shipping costs, delivery by Mondial Relay or Colissimo is free in France.

Click and Collect: CAFTAN FAMILY allows you to collect your order for free in store at the following address: 2 rue Charles de Gaulle, 95130 Le-Plessis-Bouchard. To use this service, select the “Collect” option when choosing the delivery method.

Guaranteed delivery time:
CAFTAN FAMILY undertakes to ship your order within the indicated time frame. If a delivery delay exceeds 30 days from the order date, you may request the sale to be cancelled, in accordance with Articles L 216-2 et seq. of the Consumer Code. In the event of cancellation, CAFTAN FAMILY will reimburse you for the sums paid within 14 days, excluding any compensation.

The resolution of the sale cannot be retained in the event of delay or failure to deliver attributable to the consumer or to a case of force majeure.

Verification upon receipt:
We advise you to check the condition of your package and the products delivered in the presence of the delivery person. If you notice an apparent defect, a lack of conformity or a missing product, you will have to issue reservations on the delivery note or refuse the package. You then have 48 hours (2 working days) to send us a complaint in writing (by post or email).

CAFTAN FAMILY will request supporting documents, including photos proving the non-conformity or apparent defect. Any claim made after this deadline or without supporting documents will be refused and the products will be considered compliant.

If the complaint is validated, CAFTAN FAMILY will take charge of replacing or reimbursing the product concerned, in accordance with articles L 217-4 et seq. of the Consumer Code.

- TRANSFER OF OWNERSHIP AND TRANSFER OF RISKS -

Ownership of the products is transferred to the consumer upon acceptance of the order by CAFTAN FAMILY. However, the transfer of risks of loss or deterioration of the products occurs only at the time of actual delivery, when you take physical possession of the products. In other words, the products ordered travel at the risk of CAFTAN FAMILY until their delivery.

If you notice any damage or deficiencies upon receipt, we recommend that you check the contents in the presence of the carrier and refuse the package if necessary. You should also contact the carrier without delay to report any anomalies.

CAFTAN FAMILY declines all responsibility in the event of loss or deterioration of the products once taken care of by a carrier not selected by us. Caftan Family cannot be held responsible for delays, losses or theft of packages committed by the Post Office or Mondial Relay.

- AFTER-SALES SERVICE / COMPLAINTS -

- WITHDRAWAL -

In accordance with article L 221-18 of the Consumer Code, you have 15 days from receipt of your order to exercise your right of withdrawal, without having to provide a reason.
To exercise this right, you must notify us, by post or email, of your wish to withdraw, specifying:
Your order number
Your name and surname
Your address
Your phone number
Your email address
You can also use the withdrawal form made available on the CAFTAN FAMILY website. In the event of a dispute, it is up to you to prove that you have respected the withdrawal period.
Exemption from withdrawal:
The right of withdrawal cannot be exercised for contracts:
Supply of goods made to the consumer's specifications or clearly personalized.
For the supply of goods which have been unsealed by the consumer after delivery and which cannot be returned for reasons of hygiene or health protection.

- CUSTOM MADE -

Custom-made products are made specifically according to the customer's preferences. It is important to take into account that, due to the nature of the tailoring, there may be variations in fabric shades, especially depending on available stocks. In addition, since each piece is unique, it is possible that the product is not exactly identical to the image presented. These variations are normal and are part of the customization of each order.
 
- BACK -
To be accepted by CAFTAN FAMILY, the return must meet the following conditions:
Products must be returned within 14 days of receipt.
The products must be returned in their original condition, complete (packaging, accessories, instructions, etc.), allowing them to be put back on the market in new condition, and accompanied by the purchase invoice.
Products must not be damaged, soiled, incomplete or opened (e.g. sealed cosmetics) for hygiene reasons.
You must return the package by post using Colissimo to the following address: 2 rue Charles de Gaulle, ENTREE B, 95130 Le-Plessis-Bouchard.
Refund conditions :
When all the above conditions are met, CAFTAN FAMILY will refund you the full amount paid for the returned items, EXCLUDING DELIVERY COSTS. The costs and risks of the return are your responsibility. The refund will be made via the same means of payment as that used for the initial purchase. If you agree, the refund can also be made in the form of a credit or voucher.
Return exclusions:
Purchases made on the CAFTAN FAMILY website may be refunded, under the aforementioned conditions. However, orders in confection or personalized are excluded from this right and cannot be exchanged or returned, except in the event of a lack of conformity or hidden defect.
- COMPLIANCE AND LEGAL GUARANTEES -
In accordance with article L 411-1 of the Consumer Code, CAFTAN FAMILY guarantees that the products sold comply with the requirements in force in terms of safety, health, fairness of commercial transactions and consumer protection at the time they are placed on the market.
The products supplied benefit from legal guarantees:
Legal guarantee of conformity: CAFTAN FAMILY is responsible for defects in conformity, in accordance with articles L 211-4 et seq. of the Consumer Code. This guarantee applies to defects present on the delivery date or to products that do not correspond to the order.
Legal guarantee against hidden defects: CAFTAN FAMILY is responsible for hidden defects, according to articles 1641 et seq. of the Civil Code, when the defect was hidden, existed on the date of purchase, and renders the product unusable or significantly limits its use.
To assert his rights, the consumer must act within 2 years from delivery or discovery of the hidden defect. The consumer may request a refund or replacement of the defective product, within 14 days from the discovery by CAFTAN FAMILY of the defect. The warranty does not apply in the event of misuse, normal wear and tear, accident, force majeure or unauthorized modification of the product.
- PROTECTION OF PERSONAL DATA -
In accordance with Law 78-17 of January 6, 1978 amended by Law No. 2018-493 of June 20, 2018, the personal data collected by CAFTAN FAMILY are used only for the processing of your order and its management. This data may be communicated to our partners or subcontractors for the execution of services related to the order.
The consumer may exercise his rights of access, rectification, deletion, portability, and limitation of the processing of his personal data. To exercise these rights, simply contact CAFTAN FAMILY at contact@caftanfamily.fr or by mail to 2 rue Charles de Gaulle, ENTREE B 95130 Le-Plessis-Bouchard.

- INTELLECTUAL PROPERTY -

The products for sale on the website caftanfamily.fr are the exclusive property of CAFTAN FAMILY. The content of the site, including texts, images and logos, is protected by intellectual property laws. Any total or partial reproduction is prohibited and may constitute an offense of counterfeiting.

- UNFORESEEN -

Under Article 1195 of the Civil Code, in the event of an unforeseeable change making the performance of a contract excessively onerous for one of the parties, the latter may request a renegotiation.

- FORCE MAJEURE -

Neither party shall be liable for any delay or failure to perform due to force majeure (e.g. natural disasters, epidemics, etc.)

- LANGUAGE AND APPLICABLE LAW -

These General Terms and Conditions are governed by French law and written in French. In the event of translation, only the French text will prevail in the event of a dispute.

- DISPUTES -

In the event of a dispute, we invite you to first contact CAFTAN FAMILY customer service to try to find an amicable solution. If no agreement is found, you can resort to mediation via the Consumer Mediation Commission (C. consom. art. L 612-1) or refer the matter to the competent courts.

-PRE-CONTRACTUAL INFORMATION AND CONSUMER ACCEPTANCE-

By ordering on caftanfamily.fr, the consumer fully accepts these T&Cs and agrees to pay for the products ordered, thereby waiving any contradictory document.
